Tyro Class Action

Claim Overview

The Tyro Class Action is against Tyro Payments Limited (Tyro) on behalf of Tyro customers who were affected by a system outage from 5 January 2021 onwards.

The Claim alleges that from 5 January 2021 a substantial number of Tyro’s customers experienced an outage in their connectivity to the secure payment network through which Tyro provides merchant acquiring and payment processing services (Tyro EFTPOS Facility) causing their Tyro EFTPOS payment terminals to be inoperable and incapable of repair by remote software updates (the Connectivity Issue). For up to a month, Tyro’s customers were unable to process non-cash payments while they awaited rectification of the Connectivity Issue, and experienced a substantial loss of business and goodwill as a consequence.

The Claim seeks, amongst other things, an order for damages for loss of profits and loss of goodwill suffered by Tyro customers as a result of the Connectivity Issue by reason of Tyro’s contraventions of the Australian Consumer Law.

The class action is being funded and run as a litigation funding scheme (the Scheme) in compliance with the new funded class action regulations introduced by the Australian Government in 2020.

The class action is being run by Bannister Law (the Lawyers).

Class Members – Tyro customers who utilised Tyro Eftpos payment terminals and Tyro EFTPOS Facility as at 5 January 2021.

Claim Period – 5 January 2021 onwards.
